Yes, the ball is still in play – although a distant memory for some – with regard to the litigation filed in 2007 by R-CALF USA and 10 other plaintiffs against the U.S. Department of Agriculture’s (USDA’s) decision to allow into the U.S. older Canadian cattle born after March 1, 1999, and beef from Canadian cattle of all ages.

In comments filed Tuesday with the U.S. Trade Representative (USTR), R-CALF USA laid out how the world marketplace for cattle and beef is one of the most grossly distorted markets of any sector, and how the inability to achieve any semblance of balance between disparate tariffs, subsidies and sanitary/phytosanitary (SPS) standards has wreaked havoc upon, and threatens to destroy, the U.S. live cattle industry, which historically has been the single largest segment of U.S. agriculture and which also provides the economic cornerstones for most rural communities across the United States.

R-CALF USA directors, officers and committee chairs, as well as many of its affiliate organizations, jointly sent a letter today to President Obama, Vice President Biden, Agriculture Secretary Tom Vilsack, Attorney General Eric Holder and congressional leaders that describes the U.S. cattle industry as being in an acute crisis.

It appears that in the state of Wisconsin, which has mandated the first prong of the U.S. Department of Agriculture’s (USDA’s) National Animal Identification System (NAIS) through agency rule making, prosecution of individuals opposed to NAIS has begun.

Sixteen R-CALF USA officers, directors and committee chairs today sent a strong five-page letter to the National Cattlemen’s Beef Association (NCBA) calling NCBA’s public response to Canada’s Oct. 7, 2009, announcement that it would pursue a complaint at the World Trade Organization (WTO) against the United States’ mandatory country-of-origin labeling (COOL) law “intolerable, irresponsible and deceptive, as well as a tremendous disservice to the hard-working men and women who comprise the U.S. live cattle industry.”

The Canadian government is seeking a World Trade Organization (WTO) dispute settlement process over the U.S. mandatory country-of-origin labeling (COOL) law. A WTO panel is scheduled to hear the request at the Oct. 23, 2009, meeting of WTO’s Dispute Settlement Body.

With regard to efforts by JBS S.A. (JBS) to acquire Pilgrim’s Pride Corporation (Pilgrim’s Pride), R-CALF USA sent a second submission (see Pages 6 through 9, plus exhibits) of information to the U.S. Department of Justice to reinforce evidence that shows economic harm would hit the U.S. cattle industry if Justice does not block the merger of the competing protein industries (chicken v beef).

Today, R-CALF USA sent a letter to each Senator and Representative to urge them to reject entirely the proposed ‘cap-and-trade’ legislation, also sometimes referred to as ‘pollution reduction and investment” (PRI).

R-CALF USA and 53 other organizations have joined in filing a
friend-of-the-court brief on behalf of plaintiffs in an appeal of a
lawsuit against Pilgrim’s Pride Corporation (Pilgrim’s Pride) for
violating the Packers and Stockyard Act. The lawsuit R-CALF USA joined
as an amici party is Cody Wheeler, Don Davis, and Davey Williams v.
Pilgrim’s Pride Corporation.
